    NDRN joined the ACLU in an amicus brief in Matter of Lacee L. v. Administration for Children’s Services, in the New York Court of Appeals, New York’s highest court, on behalf of a mother with an intellectual disability whose child was removed in a neglect proceeding.

Amicus Requests

Requests for NDRN to draft or join an amicus brief can be made by completing the following NDRN Amicus Request form. The requests will be submitted directly to Kenneth Shiotani, NDRN’s amicus coordinator.

Amicus requests are processed for review by NDRN’s Legal Strategy Working Group who must first review the request, and then the amicus brief itself, before NDRN may agree to sign-on to an amicus brief, or draft and file an amicus brief. It is important to submit an amicus request as far in advance of the due date as possible to allow NDRN to consider the request.

Factors influencing whether NDRN can grant a request include the importance of the issues to the P&A network, the procedural posture of the case, and the amount of time available for preparation and review of the amicus brief before it needs to be filed.  See the NDRN amicus policy for additional information on the process and timeframe.

If NDRN accepts your request, it is contingent upon our Reviewers approving the amicus brief itself. We will need a draft of the amicus brief to be made available for review at least 5 business days before the amicus filing deadline in order for NDRN reviewers to have time to meaningfully review it.
