U.S. Supreme Court Denied Petition for Certiorari in Challenge to Georgia’s Beyond Reasonable Doubt Standard to Establish Intellectual Disability

On February 28, 2022, the U.S. Supreme Court denied a petition for certiorari in Young v. Georgia, #21-782 which was a capital punishment case involving an individual with a claim that he should be exempt from capital punishment because he was an individual with an intellectual disability. The case would have presented a challenge to Georgia’s beyond a reasonable doubt burden of proof standard for individuals seeking to assert they are an individual with an intellectual disability. NDRN had joined an amicus in support of certiorari.
