Ninth Circuit Holds Plaintiffs Lack Standing Due to Moot Policy

American Diabetes Association v. U.S. Dep’t of the Army, Ninth Circuit, #18-15242

On September 18, 2019, the Ninth Circuit held that the plaintiffs lacked standing and that the case was moot after the U.S. Army changed its policy related to children with diabetes who sought to participate in the Army’s Child, Youth and School Service (CYSS) program. NDRN had joined ten civil and disability rights organizations in an amicus supporting plaintiffs.
