Learn about several cases challenging provisions of the ACA and the program’s overall structure. The outcomes of these lawsuits could change how Medicaid operates in the states if, for example, they result in loss of mandatory access to certain essential benefits, or lead to prohibitively high cost sharing, or even lead to the re-emergence of exclusionary practices such as lifetime caps and pre-existing conditions exclusions. These ongoing challenges create an atmosphere of confusion and uncertainty. Knowing the status of ACA cases and protections will help P&As educate stakeholders and work within the courts to minimize the impact of any coverage losses or losses of rights protections.
